Halfords Guarantee
These terms and conditions ("Terms") govern the provision of Halfords 2 Year/24,000 mile Guarantee on Halfords Branded Goods only (the "Goods") and We Fit Services (the "Services") sold by Halfords to its customers ("Customers") (the "Guarantee"). These Terms set out the scope of the Guarantee, applicable rights and obligations, and the process for making a claim. This Guarantee is provided in addition to, and does not affect, your Statutory Rights under applicable UK law.
Definitions
- In these Conditions, the following definitions shall apply:
- "Customer" means the individual that has purchased the Goods or Services from Halfords.
- "Goods" means Halfords Branded Goods Halfords own Goods only (including Apollo, Assist, Boardman, B98, Carrera, Indi, Ridge, Pendleton, Voodoo, Slick Pete’s) which have been purchased from Halfords.
- "Guarantee" means the two (2) year/24,000 miles guarantee provided by Halfords for the Goods and Services following registration (as detailed in clause 2.2 below).
- "Halfords" means Halfords Limited (Company Number 00103161) in respect of Halfords retail stores and the Halfords website only, of Icknield Street Drive, Washford West, Redditch, Worcestershire, B98 0DE, in respect of Halfords Autocentres, means Halfords Autocentres Limited (Company Number 04050548) and in respect of National Tyres, means National Tyre Service limited (Company Number 00986754 all of the same address.
- "Halfords Website" means www.halfords.com
- "Service(s)" means the installation and fitting of the Goods and other non-branded goods by Halfords to a vehicle, bicycle or scooter.
- "Statutory Rights" means the rights granted to consumers under applicable UK consumer protection legislation, including but not limited the Consumer Rights Act 2015.
- In these Conditions, the following rules apply:
- Any phrase introduced by the terms including, include, in particular or any similar expression shall be construed as illustrative and shall not limit the sense of the words preceding those terms.
- A reference to writing or written includes e-mails.
- In these Conditions, the following definitions shall apply:
Scope and Duration
- This Guarantee covers the Goods and Services purchased from Halfords for a period of two (2) years or for 24,000 miles (whichever is sooner) (the "Guarantee Period"), commencing form the date of purchase or the provision of the Goods or Services.
- The Customer must register the Goods and/or by providing their valid email address at the point of purchase for the Guarantee to apply. Failure to register does not affect any statutory rights which may apply under UK consumer law.
- The Guarantee applies only to Goods and Services used within the United Kingdom, including Northern Ireland, unless otherwise stated.
- There is only one (1) Guarantee per each Goods and/or Services.
- The Guarantee does not transfer to any replacement Goods or Services.
- The Guarantee is not transferrable and only applies to the Customer.
- The Guarantee does not apply to Goods and/or Services purchased for commercial, business, or resale purposes.
- This Guarantee is provided free of charge and operates in addition to your Statutory Rights. It does not affect your rights under consumer protection laws. For additional information about your Statutory Rights, please contact your local Trading Standards office or Citizens Advice Bureau.
Remedies
- During the Guarantee Period and upon proof of purchase by the Customer, Halfords will, at its sole discretion:
- you will need to select the Goods and/or Services you require and complete and submit the order form ("Order Form"). You submit the Order Form by clicking on the 'place order' button;
- your Order will be accepted when we email you to confirm acceptance of your Order, at which point a Contract will be formed. The order confirmation email will include: (i) your order number and personal details, (ii) the price of the Goods and/or Services, (iii) the estimated delivery date of the Goods, (iv) the commencement date of any Services and (v) will attach these Conditions.
- For the Services, Halfords will reperform the Service or provide a remedy equivalent to its original cost, as deemedappropriate byHalfords.
- Remedies under this Guarantee are limited to the original purchase amount of the Goods or Service and exclude any consequential, incidental, or indirect losses.
- Replacements will be made with equivalent items of the same type, quality, and functionality as the original Goods.
- During the Guarantee Period and upon proof of purchase by the Customer, Halfords will, at its sole discretion:
Guarantee Procedure
- To make a claim under this Guarantee, the Customer must:
- Notify Halfords of the fault or defect within seven (7) days of discovering it and no later than thirty (30) days after the fault becomes apparent;
- Provide proof of purchase, such as e-receipt confirming registration, invoice, or delivery confirmation; and
- Submit all claims Halfords Customer Service or the Halfords retail store where the Goods or Services were purchased.
- Halfords may require the Goods to be returned to a designated service location for inspection. The Customer will be advised of any return requirements or collection arrangements during the claims process.
- Where Goods need to be repaired or replaced, Halfords will use reasonable efforts to complete such repairs or replacements within thirty (30) days of receipt of the returned Goods. If repairs or replacements cannot be completed within this timeframe, the Customer may request a refund.
- To make a claim under this Guarantee, the Customer must:
Exclusions and Limitations
- The Guarantee does not apply to:
- Goods that have been misused, abused, neglected, or modified in any way not authorised by Halfords;
- Non-Halfords branded Goods;
- Perishable goods or consumable items,normal wear and tear, including but not limited to standard lifetime expectation of the Goods, cosmetic damage, scratches, and dents that do not materially affect performance;
- Perishable items, wearableparts or consumable items on bicycles;
- Digital products or downloadable software where defects are not attributable to Halfords, including compatibility issues with third-party systems or updates; and
- Damage resulting from external factors, such as power surges, natural disasters, or accidental damage by the Customer.
- This Guarantee excludes any consequential or indirect losses, including but not limited to loss of use, loss of profit, or damage to other property, except where such exclusions are prohibited by law.
- The Guarantee does not extend to repairs or services performed by third parties.
- The Guarantee does not apply to:
Customer Obligations
- The Customer shall ensure that:
- They register the Goods and/or Service for the Guarantee to applyin accordance withclause 2.2 above;
- Goods are used and maintainedin accordance with the provided instructions or user manual; and
- Any issues with the Goods or Services are reported promptly in accordance with Clause 4.
- Misuse includes, but is not limited to, failure to clean, prolonged exposure to moisture, or use of the Good in a manner inconsistent with its intended purpose.
- The Customer shall ensure that:
Statutory Rights
- This Guarantee operates independently of and in addition to your Statutory Rights. Nothing in these Terms shall exclude or limit any rights or remedies available to you under applicable legislation, including but not limited to your right to reject faulty goods within thirty (30) days of purchase under the Consumer Rights Act 2015.
Governing Law
- These Terms are governed by and construed in accordance with the laws of England and Wales.
- Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
Amendments and Miscellaneous
- Halfords reserves the right to revise these Terms at its discretion for future sales, but no amendment shall affect the terms of any previously issued Guarantees unless agreed in writing by both parties.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver by Halfords of any breach of these Terms shall not constitute a waiver of any subsequent breach.
